Anyone can bring a lawsuit against anybody anytime for any reason. That, however, does not mean that every lawsuit has merit or will be successful.
When you commence a lawsuit you must be able to support your claims both factually and legally. For example, you may be able to prove that another person actually did something but you may not be able to show that the commission or omission of that act has any legal import. Conversely, you may be able to show that a certain act or omission imposes liability but you may not be able to prove that the other party actually did or failed to do the alleged act. Either case would lead to an unsuccessful result. You also must be able to prove that you have suffered some type of determinable injury. Additionally, if you do win, you need to know if the person or entity you are suing has any assets (or insurance) in order to satisfy the judgement.
Making a legal claim against another party requires the retaining of an attorney, payment of court and case fees and expenses, possibly the retention of an expert or experts and your time. You should be certain that you have a viable claim before you commence any proceeding.
You should gather all of your evidence in order to make a determination as to whether or not you should commit the resources necessary to institute litigation.
